What happens if a Samsung Memoir phone was stolen?

Hi Yahoo. I was on craiglist and someone is willing to sell me their phone for 150. It doesn't have a box and doesn;t have manuel, just a usb charger. I'm thinking that it could possibly be stolen and I was wondering what if it really was? Will it be deactivate and etc? Will i get in trouble for buying a stolen phone? Thanks
